1. Acceptance of Terms

By accessing or using the PulseHub platform, including its web application, mobile application, APIs, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you are accessing the Service on behalf of an organization, you represent that you have authority to bind that entity.

2. Description of Service

PulseHub is an enterprise operations command center that aggregates real-time metrics, performance data, and operational intelligence from connected applications and data sources. The Service provides dashboards, KPI monitoring, activity feeds, and analytics tooling for operations teams and administrators.

The Service is provided by Mengel Enterprises LLC, 125 S. Jefferson St., Chicago, IL 60661.

3. Accounts and Access

3.1 Account Registration

To use the Service, you must create an account with accurate, current, and complete registration information.

3.2 Account Security

You are responsible for maintaining the security of your credentials and all activity under your account. Notify us immediately at security@pulsehub.studio if you suspect unauthorized access.

3.3 Organizational Accounts

Administrators are responsible for managing access and ensuring members comply with these Terms.

4. Subscriptions and Payment

4.1 Subscription Plans

The Service is offered under subscription plans described at pulsehub.studio/pricing.

4.2 Billing

By subscribing, you authorize us to charge your payment method on a recurring basis per your selected plan. Payment processing is handled by Stripe, Inc.

4.3 Refunds

Subscription fees are generally non-refundable. We may issue credits for service outages attributable to us.

4.4 Taxes

You are responsible for all applicable taxes, which may be added to your invoice.

5. Data Integration and Connected Sources

5.1 Your Data Sources

You may connect PulseHub to third-party applications, databases, APIs, or other data sources ("Connected Sources"). You represent that you have all necessary rights, licenses, and permissions to provide PulseHub access to any Connected Source.

5.2 Data Accuracy

PulseHub displays data as provided by your Connected Sources. We do not warrant the accuracy, completeness, or timeliness of aggregated data. You are responsible for verifying data before relying on it for business decisions.

5.3 Disconnection

We are not responsible for data interruptions resulting from Connected Source changes or revocations of access.

6. Acceptable Use

You agree not to use the Service to:

  • Access or aggregate data from sources for which you lack authorization
  • Attempt to reverse-engineer, decompile, or extract source code from the Service
  • Use the Service to conduct unauthorized surveillance of individuals
  • Circumvent access controls, rate limits, or security features
  • Use the Service in violation of any applicable law or regulation
  • Resell or sublicense access to the Service without our written consent

7. Intellectual Property

All rights in the Service — including software, interfaces, branding, documentation, and underlying architecture — are owned by Mengel Enterprises LLC. You retain all rights to data you bring into or generate through the Service.

8. Disclaimer of Warranties

The service is provided "as is" and "as available." To the maximum extent permitted by law, Mengel Enterprises LLC disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and accuracy of aggregated data.

9. Limitation of Liability

To the maximum extent permitted by law, Mengel Enterprises LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages. Our total liability to you shall not exceed the greater of (A) amounts paid by you in the twelve (12) months preceding the claim, or (B) one hundred dollars ($100).

10. Indemnification

You agree to indemnify and hold harmless Mengel Enterprises LLC from claims arising out of your use of the Service, data you connect or provide, your violation of these Terms, or your violation of any third-party rights.

11. Term and Termination

These Terms remain in effect for the duration of your active subscription. You may cancel at any time through account settings, effective at the end of the current billing period. Sections on IP, liability, indemnification, and governing law survive termination.

12. Governing Law

These Terms are governed by the laws of the State of Illinois. Disputes shall be resolved exclusively in the state or federal courts of Cook County, Illinois.

13. Changes to These Terms

We may update these Terms at any time with at least 14 days' advance notice for material changes. Continued use after the effective date constitutes acceptance.
